Terms of Service
These Terms of Service ("Terms") are an agreement between you and Jukebaxx ("Jukebaxx", "we", "us"), Block 08, Apartment 190, McIntyre Villa, Kingston 16, Jamaica. By creating an account or using Jukebaxx you agree to these Terms, the Privacy Policy and the Community Guidelines.
1. Who can use Jukebaxx
You must be at least 18 years old and able to enter a binding contract. You confirm this when you sign up. One person, one account; keep your sign-in details private and tell us if you think someone else has used your account.
2. What Jukebaxx is
Jukebaxx is an online marketplace where collectors list physical vinyl records and others bid on them in timed auctions. Jukebaxx provides the platform; sellers are independent members. Unless we clearly say otherwise, we are not the seller of any record and do not take ownership of records.
3. Listings and bidding
- Sellers must describe a record honestly (grade, pressing, defects) and may list only items they own and are allowed to sell.
- A bid is a binding offer. If you win, you must complete payment within the payment window shown at checkout. Winners who do not pay may lose bidding privileges.
- Bidding requires "Bid Clearance": a card saved with our payment provider (Stripe). Saving it is not a charge.
- If you win, your saved card is charged automatically. By bidding you authorize Jukebaxx to charge the card saved for Bid Clearance for the winning amount plus the listed shipping as soon as the auction closes, without asking you again, and to ship to that card's billing address unless you tell the seller otherwise. If the charge is declined or your bank asks for confirmation, you must pay through checkout within the payment window shown.
- Temporary holds. When you lead an auction above US$150 (a limit we may change) in its last 48 hours, we may place a temporary authorization hold for the current price plus shipping on your saved card. A hold is not a charge; it is released if you are outbid or the auction ends unsold, and it is used as your payment if you win. If the hold is declined, your leading bid may be withdrawn.
- Bidding limits. Until you have completed 3 purchases, the total of your leading maximum bids and unpaid wins may not exceed US$500 (a limit we may change).
- Unpaid wins. If you do not pay for a win within the payment window, the sale is cancelled and your bidding is suspended until our support team reviews it. The record may then be offered to the next-highest bidder at that bidder's own maximum bid; that bidder may accept or ignore the offer, and ignoring it has no penalty.
- Bids must beat the current price by the minimum increment shown (US$1 under US$25, US$2 from US$25 to under US$100, US$5 from US$100). Auctions extend by 2 minutes when a bid arrives in the last 2 minutes (soft close). Our server's clock decides when an auction ends. Reserve prices and other rules shown on the listing apply.
4. Payments, fees and payouts
Buyer payments are processed by Stripe. We do not store card numbers. Our marketplace fee works like this: sellers pay a commission of 10% of the final sale price (the winning bid), deducted from the seller's payout; buyers pay no marketplace fee; and shipping is passed through at cost (the shipping charge is for the seller's postage and carries no commission). We will give notice before any change to fees, and a change never applies to a sale that has already been completed. Taxes and shipping are shown at checkout where applicable. Stripe's own terms apply to payment processing.
Seller payouts
- Payout method. Sellers are paid in US dollars either through a Stripe connected account (where Stripe supports the seller's country) or by PayPal, to the PayPal email address the seller saves in Account → Payouts. You are responsible for entering the correct address and for keeping that PayPal account able to receive USD. We are not responsible for a payout sent to an address you gave us. A new or changed PayPal address is subject to a short safety delay before payouts are sent to it. Jukebaxx pays PayPal's payout fee; PayPal's own terms, limits and any fees PayPal charges you for receiving or withdrawing money apply to your PayPal account.
- When a payout is released. A payout is released only after the buyer has confirmed delivery and the inspection window has ended without an open dispute, plus a short additional hold (currently 7 days after delivery). It is not released while a refund request or dispute on that sale is open.
- Reserve. We hold back a reserve (currently 10% of your net payout on each sale) for longer (currently a further 30 days after the main payout) and then pay it out, unless it has been used to cover a refund, chargeback or dispute loss as described below.
- Refunds, chargebacks and dispute losses. If a buyer is refunded, wins a dispute, or the card network reverses the payment, the amount is not owed to you. If you were already paid, the amount is deducted from your reserve first and then from your future payouts until it is recovered, and we may hold payouts while a dispute is open.
- Unclaimed or failed payouts. If a PayPal payout cannot be delivered (for example the address has no PayPal account, the account is restricted, or the payout is returned), the money stays yours and we retry once you correct the address; PayPal returns an unclaimed payout after 30 days.
- Tracked shipping. Sales of US$150 or more (a limit we may change) must be shipped with a tracking number before the sale can be marked shipped.
5. Shipping, inspection, refunds and disputes
Sellers must ship promptly and provide tracking (required for sales of US$150 or more). After delivery the buyer has an inspection window to accept the record or open a dispute (for example: not as described, damaged, or not received). We may hold payouts, approve refunds, or reverse a sale where the rules in these Terms and the dispute process call for it; refunds and chargebacks on a sale that was already paid out are deducted from later payouts (see Seller payouts in section 4). Card-network chargebacks are handled with Stripe and may pause the order.
6. Prohibited conduct
You may not post counterfeit, bootleg-misdescribed or stolen items; use the service for fraud, harassment, hate or illegal goods; manipulate bidding (shill bidding, collusion); circumvent fees by taking sales off-platform; scrape or attack the service; or break the Community Guidelines.
7. Content you post
You keep ownership of photos and text you upload, and give us a worldwide, non-exclusive licence to host and display them in connection with the service. You promise you have the right to post them. We may remove content that breaks these Terms or the Community Guidelines.
8. Reporting, blocking and moderation
Members can report listings and members and can block other members inside the app. We review reports and may remove listings, suspend or close accounts, and cooperate with law enforcement where required. See the Community Guidelines.
9. Your account and deletion
You can delete your account at any time in the app (Account → Safety & privacy → Delete account) unless you have open auctions with bids, active bids, unfinished sales, open disputes or pending payouts. We keep transaction and payment records in anonymised form where required for accounting, tax, fraud-prevention and legal reasons. We may suspend or close accounts that break these Terms.
10. Disclaimers and liability
The service is provided "as is" and "as available". Jukebaxx does not guarantee the condition, authenticity or legality of any record listed by a member. To the extent allowed by law, our total liability to you for any claim relating to the service is limited to the greater of the fees you paid us in the 12 months before the claim and US$100. Nothing in these Terms limits liability that cannot be limited by law, including your statutory consumer rights.
11. Changes
We may update these Terms. If a change matters, we will ask you to accept the new version in the app. The version shown above is the one recorded when you accept.
12. Governing law and disputes
These Terms are governed by the laws of Jamaica. Disputes will be handled in the courts of Jamaica, sitting in Kingston, unless mandatory consumer law gives you the right to bring a claim elsewhere.
